After a DOT drug or alcohol violation, you cannot perform safety sensitive functions such as driving a CMV until you complete the return to duty process.

The steps

  1. Substance Abuse Professional (SAP) evaluation. A DOT qualified SAP assesses you and recommends education or treatment.
  2. Complete the program. Finish everything the SAP recommends.
  3. Follow up evaluation. The SAP confirms you completed it.
  4. Return to duty test. A directly observed test with a negative drug result and/or an alcohol result below 0.02.
  5. Follow up testing. At least six unannounced tests in the first 12 months, which the SAP can extend for up to five years.

An important difference

Return to duty clears a DOT testing violation. It does not shorten a CDL disqualification from a DUI conviction. Those are separate penalties and both must be resolved.

Prepare for the job search

Some carriers will not hire drivers with a recent violation. Keep copies of every document, and consider brushing up with a current CDL study guide.
